Who Is Liable When AI Fails? Dr. Jörg Kahler on the Legal Framework for Autonomous Driving

As artificial intelligence takes on an increasingly important role in automated and autonomous vehicles, one question is becoming critical for manufacturers, software developers and technology providers: Who is liable when the program or algorithm fails?

At eMove360° Europe 2026, Dr. Jörg Kahler, Partner at GSK Stockmann, will examine how European AI and product liability legislation is changing the legal framework for autonomous mobility.

His presentation, “How does the law on AI influence automated or autonomous driving?”, will look at the interaction between the EU AI Act and the revised EU Product Liability Directive and what these regulations mean in practice for AI systems and autonomous vehicles.

A particular focus will be on the changing concept of product liability in the software-defined vehicle. Liability no longer ends with the physical vehicle delivered to the customer. Software, AI algorithms, updates, upgrades and connected digital services can all become relevant when determining responsibility for a defective product.

Dr. Kahler will address key issues including:

  • the legal regime created by the EU AI Act and revised Product Liability Directive
  • the impact of these rules on AI systems and autonomous vehicles
  • liability associated with software updates, upgrades and digital services
  • new categories of potential damage, including data loss and non-material damage
  • practical consequences for vehicle manufacturers and software developers

The topic is particularly relevant as vehicles increasingly evolve after production through software updates and AI-based functions. For OEMs and technology companies, understanding who carries responsibility throughout the lifecycle of the vehicle is becoming as important as the underlying technology itself.
